Grant of 1st MACP to all the former PWM, PWS, SrPWS & Track Supervisors

Indian Railway Permanent-Way Association (IRPWA) continue urging to the both labour Federations – AIRF & NFIR – about the grant of 1st financial up-gradation (MACP) to the all former PWM, PWS, SrPWS & Track Supervisors subsequently upgraded as JE/P.Way – GP 4200 -Level-6 of pay matrix in Railways.

Till date no necessary correspondence or action taken by the both Federation about IRPWA’s note dated 25.09.2020 & 27.10.2020.

In continuation of note dated 25.09.2020 and verbal discussion on 28.09.2020. They want to state that Railway Board letter No. PC-III/2005 CTC-1/8 dtd. 08.03.2019 arising out SLP No. (C) 25769 of 2014 in WP No. 3677/2013 instructed that, “it has been decided to implement the order dated 23.11.2017 of the Hon’ble Supreme court in respect of the respondents only“.

Accordingly Northern Railway implemented the Supreme court’s order vide letter No. 724E/Court Case/EIIBI/ dtd-18.03.2019 (Copy enclosed). A copy of pay fixation of Sri Ram Gopal Yadav is attached for your ready reckoner against NFIR PNM item No. 28/2012. 

Still decision on PNM item No. 28/2012 is pending on account of separate meeting.

Railway Board organise a monthly meeting with both Federations in every month on second Friday communicated vide their letter No. 2020/E(LR)I/Misc dt 14.010.2020.

Now they are mainly suffering from following two issues –

1. Grant of 1st MACP from date of joining (Excluded apprentice period)

2. Performa pay fixation in the light of Supreme court decision which may come under PNM item No. 28/2012

Railway Board played with our future by issuing orders for changes of designation name from PWM, PWS, SrPWS, Track Supervisors, as a time interval without any change in duty, work and responsibility.

Once again in the terms of Railway Board order no. 64/2013 letter No. PC-III/2012 /FE-11/2 date 03.07.2013, It was decided to upgrade/merger of category of SrP.Way Supervisor (Sr.PWS) to JE/P.Way and the whole post/cadre of SrPWS was upgraded in Post of JE/P,Way. 

Railway Board already gave clarification under MACP to ECRailway vide letter No. PVV/2010/MACP/7/ECR dated 04.09.2014 as – 

“The employee joining a post in Grade of Rs 4200 on direct recruitment basis may be consider for grant financial upgradation in Grade pay of Rs 4600, Rs 4800 and Rs 5400 of PB-2, provided that no two successive grade i.e. feeder and promotional are in same grade pay”.

As in present scenario i.e. 7th CPC keeping in view that the post of PWM, PWS, Track Supervisor (those who upgraded in Sr.PWS) was abolished and upgraded into in JE/P.Way (in 6th CPC), No such any appointment and promotion by Railway on the post of PWM, PWS, Track Supervisor and Sr.PWS.

Now JE/P.Way in Rs 4200 (Level-6) is feeder post for us and those who got promotion into SSE/P.Way Rs 4600 (Level-7) if they have got major penalty and reverted in feeder post be become JE/P.Way of Rs 4200 (Level-6).

Those who join from/after 22.03.2007 in Sr.PWS Rs 4200 are eligible for 1st MACP of Rs 4600 after completion of 10 year (excluding apprentice period).

But who join before 22.03.2007 on the post of PWM, PWS, Track Supervisors are not eligible for 1st MACP in Rs 4600.

In the matter of ASM/SM, Federations resolve MACP alimony to all cadre of ASM/SM vide RBE No. 26/2020, vide letter No. PC-VII/153 PC-V/2018/MACP/1(SM) dtd 25.02.2020.

Railway Board consider the DOPT’s office memorandum No. 35034/3/2015-Estt (D) dated 22.10.20219 in this case Railway Board circulated vide RBE No. 16/2020 dated 04.02.2020, in the last line letter dtd 25.02.2020, “the benefit of MACP ignoring promotion”.

It also stated in DOPT’s office memorandum No. 35034/3/2015-Estt.(D) dated 22.10.20219 at para 5 –

“Promotion earned/upgradation granted under the MACP Scheme in the past to those grade which are in the same Level in the Pay Matrix due to merger of pay scales / upgradations of posts recommended by the 7th CPC shall be ignored for the purpose of granting upgradations under Modified ACPS. The benefit of merger will accrue w.e.f. the date of notification of the Recruitment Rules for the relevant post”.

At present approximately 80% of SSE/P.Way (IC) then CPWI belong to this cadre. 

From the above, it is clear that similar to the case of ASM/SM, GP Rs 4200 (Level 6) is the initial level for all purposes for all PWM, PWS, SrPWS, Track Supervisors who joined before 22.03.2007.

Therefore, GP Rs 4600 (Level 7) may be granted as 1st financial upgradation under MACP to all former PWM, PWS, Track Supervisors considering their appointment in GP-4200 form their date of joining.

Therefore, again and again they are urges to the GS/AIRF and GS/NFIR for resolving the following issues from Railway Board in monthly meeting which schedule to be held on every 2nd Friday of the every month for issuing –

1. Grant of 1st MACP from date of joining (Excluded apprentice period).

2. Performa pay fixation in the light of Supreme court decision which may come under PNM item No. 28/2012.
